Your “found” content can come back to bite you one day.

It’s true. A LOT (and I mean WAYYYYYY too many) entrepreneurs seem to think that if they find a photo that has been posted online it’s okay to use for their own marketing and social media.

I mean…it’s online and in public view, that means I can use it, right?

WRONG!

In fact, there are a LOT of misconceptions about fair use and copyright but I am going to dig into the ones that are most often ignored…PHOTOS.

Article I, Section 8, clause 8, of the United States Constitution states the purpose of copyright laws is “to promote the Progress of Science and useful Arts, by securing for limited times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.”

Copyright is there at the birth of creation. If you write it, click that shutter on your camera, draw it paint it WHATEVER, it’s yours. You do not have to file any special paperwork or anything, you created it. I like to tell myself that I retain copyright on my children, if anyone tried to clone them without my permission, I would go after their asses and win. LOL.

Now, the copyright holder can do 4 things automatically.

THAT MEANS that the moment the copyright holder puts their image online is NOT the moment they’re giving up their rights to copyright…they’re just exercising their right to do number 4.

So what does that mean for you?

That means that when you’re scrolling google and you find a photo that you love you CANNOT TAKE IT. If you do and the person who created that image finds out they CAN (and by that I mean they have every right to) take legal action for copyright infringement.

“WHAT CAN I DO, NICOLE? I DON’T HAVE TIME TO CREATE CONTENT IN THE VOLUME THAT I NEED IT TO REMAIN ACTIVE ON SOCIAL MEDIA?”

Well, you are going to need to either hire a photographer to take unique photos for you and sign an agreement with them that says you CAN use their photos and what you are able to use them for. OR you can join a stock website and pay special mind to the agreements you sign when you purchase. I like to say that if it’s FREE, it’s usually TOO GOOD TO BE TRUE.
